Terms & Conditions For Your SOS GPS Smart Tracker

These are the full terms and conditions for the product and service associated with the SOS GPS Smart Tracker.

YouYou the customer with whom we make the agreement

(1). The SOS GPS Smart Tracker is a wearable device that utilises a roaming SIM on mobile networks to send signals in the event of a fall or if the button is pushed.  When activated, the device will send a signal to our nominated monitoring station and if applicable the smart application.  A 2 way audio call will begin with the monitoring station who will take appropriate action depending on the nature of the activation.

(2). Due to the nature of mobile networks, mobile signals and available coverage then we can not accept any responsibility or liability in the event of signals not received or sent to the monitoring station or mobile app.

(3). It is important that the device is kept in a good condition and maintained to ensure functionality and that any faults or damage are reported to us immediately.  The device must have sufficient battery charge to function.  No liability can be accepted on any loss of service due to the device being faulty, damaged or not sufficiently charged.

(4). The SOS GPS Tracker device requires a subscription service to Protect & Serve Home Security Limited, in return we will provide a roaming SIM card, connection to the monitoring station, response services and access to a smart phone application if applicable.  You agree to pay us either an agreed monthly figure or annually to continue to provide these services.  If you enter into a monthly agreement with us, you agree to pay the agreed amount via direct debit each month for a minimum period of 12 months.  At the end of the 12 month minimum term, you have the right to cancel your agreement with us after providing 30 days notice or the agreement continues on a rolling monthly basis from the date the agreement was entered into.  Should you fail to maintain your monthly payment with us, then we reserve the right to remove the services associated with the device which will result in the device not signalling and no response to any activation.

(5). The device is paid for in advance and you own the equipment. A 12 month warranty from the date of purchase is provided which covers faulty devices, it does not cover devices for accidental damage, not charged each day or if used incorrectly.  Incorrect use is determined by an inspection from Protect & Serve Home Security Limited.

(6). Although the fall detection feature of the device has been tested, there are many external factors such as, but not limited to, the position of the device, the type of fall, an object or person breaking the fall that may or may not result in the device detecting an incident has occurred.  Protect & Serve Home Security Limited does not accept liability should the device not accurately detect a fall.

(7). You have the right to cancel within 14 days after the day this agreement is entered into by you and us.  After 14 days, the subscription service will continue for a minimum period of 12 months and cannot be cancelledshould you change your mind.  This does not affect your statutory rights.  Should you wish to cancel within the 14 day period then please let us know by either telephoning 0333 666 2121 or e-mailing us at enquiries@protectserve.co.uk.  No refunds will be provided on the device itself unless returned to us in an unused condition in it’s original packaging within 28 days.
